Terms and Conditions
These Terms explain how awaKart works and set out the responsibilities of buyers, vendors, riders, and the platform when using our campus marketplace.
Please read before using awaKart
By accessing or using awaKart, you agree to these Terms. They describe how orders, payments, deliveries, complaints, and investigations are handled. If you do not agree with these Terms, please do not use the platform.
awaKart is powered by Algoritic Inc. In these Terms, “awaKart,” “we,” “us,” and “our” refer to the awaKart platform and its operation through Algoritic Inc., subject to the identity of the contracting legal entity and applicable law.

1. Acceptance of These Terms
These Terms and Conditions govern your access to and use of awaKart, including the website, marketplace features, account services, ordering process, payment coordination, and delivery arrangements made available through the platform.
By creating an account, placing an order, listing goods, registering as a rider, or otherwise using the platform, you confirm that you have read and understood these Terms and agree to comply with them.
Additional terms may apply to specific services, promotions, or transactions. Where additional terms apply, they should be made available to you before they take effect. Nothing in these Terms removes any right that cannot lawfully be excluded under Nigerian law.
2. Platform Ownership and Operation
awaKart is a campus marketplace platform powered by Algoritic Inc., a software company that builds digital products and technology solutions.
Algoritic Inc. provides the technology and administrative framework through which awaKart operates, subject to applicable agreements and the responsibilities described in these Terms.
The name “awaKart” identifies the marketplace platform. It does not, by itself, establish that awaKart is a separate incorporated legal entity. References to the platform operator must be read alongside the correct contracting entity and its official business details.
Unless expressly agreed otherwise, buyers purchase goods from vendors, and riders perform delivery services under the platform's approved delivery arrangements. The use of awaKart does not automatically make vendors or riders employees, agents, or legal partners of Algoritic Inc.
3. Eligibility and Accounts
You must provide accurate information when creating or using an awaKart account. You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account, except where applicable law provides otherwise.
- Do not impersonate another person or use another person's account without permission.
- Keep your name, contact information, delivery details, and other required account information reasonably accurate and up to date.
- Notify awaKart through its official support channel if you suspect unauthorized access or misuse of your account.
- Vendor and rider accounts may be subject to additional checks, approvals, and eligibility requirements before relevant features become available.
We may request reasonable information needed to verify an account, prevent fraud, support a transaction, or comply with applicable law. We may restrict or close accounts in accordance with these Terms and applicable law where information is materially false, activity presents a credible risk, or a serious breach occurs.
4. How awaKart Works
awaKart provides an online marketplace through which buyers can discover goods offered by vendors. Where available, the platform also coordinates payment collection, order administration, and delivery through riders approved by awaKart.
Buyers
Browse listings, place orders, pay applicable charges, and provide accurate delivery details.
Vendors
Maintain listings, prepare orders, and fulfil confirmed purchases accurately.
Approved riders
Collect assigned orders, maintain custody during delivery, and provide delivery evidence when required.
Payment coordination
awaKart coordinates payment collection and subsequent settlements according to the applicable transaction and settlement process.
Product availability, delivery coverage, estimated delivery times, and payment methods may vary. A listing, checkout screen, or delivery estimate does not guarantee availability until the relevant order is accepted and confirmed.
awaKart may update, suspend, or discontinue features for operational, technical, safety, or legal reasons. Where reasonably practicable, we will communicate material changes that affect active transactions.
5. Buyer Responsibilities
Buyers are responsible for reviewing the information presented before placing an order and for providing information necessary to complete the transaction.
- Check product descriptions, variations, quantities, prices, and any relevant conditions before paying.
- Provide an accurate delivery location and contact details, and remain reasonably reachable during the agreed delivery window.
- Pay the displayed order total and applicable delivery or processing charges through the payment methods provided by awaKart.
- Do not falsely claim that an order was missing, damaged, incomplete, or undelivered.
- Report genuine order or delivery problems promptly and provide relevant information or evidence reasonably requested to investigate the complaint.
A buyer must not harass vendors or riders, misuse another person's information, manipulate reviews, or attempt to bypass platform payment or security procedures.
If a buyer cannot receive an order, provides incorrect details, or is unavailable at the agreed delivery location, additional delivery arrangements or reasonable extra costs may apply where disclosed, justified, and permitted by law.
6. Vendor Responsibilities
Vendors are responsible for the goods they list and sell through awaKart, including the accuracy of their listings and their fulfilment of accepted orders.
- Provide truthful product descriptions, accurate prices, relevant variations, and genuine product images where applicable.
- List only goods that you are lawfully permitted to sell and that comply with platform rules and applicable law.
- Maintain reasonable stock accuracy and promptly communicate stock shortages or fulfilment problems.
- Prepare orders in the agreed condition and make them available for collection within the communicated timeframe.
- Package goods appropriately for the type of item and the expected handling and delivery conditions.
- Cooperate with genuine complaints and evidence-based investigations into an order.
Vendors must not substitute products without appropriate buyer agreement, inflate prices after an order has been accepted, manipulate order statuses, or falsely claim that goods have been handed over or delivered.
Vendors are responsible for the legality, quality, description, safety, and conformity of goods they supply, subject to applicable law. awaKart does not independently guarantee every vendor statement or product listing.
Vendor settlements are processed according to the platform's applicable settlement procedures, transaction status, and any genuine unresolved issue affecting the relevant order. Vendors must provide accurate settlement details and promptly report suspected payment errors.
7. Rider Responsibilities
Only riders who have registered with awaKart and received the required approval may accept or perform deliveries assigned through the platform. Registration alone does not guarantee approval or continued access to delivery assignments.
- Provide accurate registration, identity, contact, and other reasonably required verification information.
- Accept and perform assignments only when eligible, available, and reasonably able to complete the delivery safely.
- Verify the order and pickup information before leaving the vendor's collection point.
- Handle goods carefully and maintain reasonable custody and security from collection until delivery or an authorized handover.
- Use the delivery process provided by awaKart and submit accurate delivery confirmations and supporting evidence when required.
- Promptly report delays, accidents, damaged packaging, missing items, failed deliveries, or other incidents affecting an assignment.
Riders must not open, use, replace, consume, misappropriate, or intentionally damage goods entrusted to them. They must not falsely report a delivery as completed, collect unauthorized payments, or hand goods to an unauthorized recipient where recipient verification is required.
Riders must follow applicable traffic, safety, and other legal requirements. Approval may be suspended or withdrawn where justified by safety concerns, substantiated misconduct, failure to maintain required eligibility, or other grounds permitted by these Terms and applicable law.
8. Pickup, Custody and Delivery
Clear handovers help protect buyers, vendors, and riders. The following principles apply to orders handled through awaKart:
Before collection
The vendor should prepare the correct order and make it available to the assigned rider. The rider should reasonably verify the order identity, quantity, packaging, and visible condition before accepting custody.
During delivery
The rider should take reasonable precautions to prevent loss, damage, tampering, or unauthorized access and should report incidents without unnecessary delay.
At handover
The rider should follow the applicable recipient-verification process and record delivery accurately. The buyer should check the order as reasonably practicable and report discrepancies promptly.
If a delivery cannot be completed, the rider should notify awaKart and follow the authorized instructions for a retry, return to the vendor, safe temporary holding, or another appropriate resolution. A rider should not independently dispose of, retain, or redirect goods without authorization except where immediate action is reasonably necessary to protect safety or comply with law.
Responsibility for loss or damage will be assessed using the available evidence, the circumstances of the handover, the conduct of the parties, and applicable law. A party is not automatically responsible for every incident merely because the incident occurred while an order was being processed.
9. Missing, Stolen or Damaged Goods
If goods are missing, stolen, damaged, substituted, incomplete, or not delivered, the affected party should report the issue promptly through awaKart's official support channel. Reports should include the order reference and a clear account of what happened.
Depending on the circumstances, relevant evidence may include:
- Order details, item descriptions, quantities, and payment records.
- Pickup and handover confirmations, timestamps, order-status history, and communications relating to the delivery.
- Relevant photographs, packaging condition, delivery confirmation, recipient verification, or other lawfully obtained supporting material.
- Statements from the buyer, vendor, rider, or other people directly involved.
Evidence will be considered in context. A missing photograph, a delayed response, or a party's denial does not by itself prove that the party is responsible. awaKart may ask each involved party for a reasonable explanation or additional information.
Where the available evidence supports a finding that a party caused or materially contributed to a loss or damage, awaKart may pursue an appropriate resolution consistent with these Terms, the relevant transaction, and applicable law. Depending on the circumstances, this may include a replacement, redelivery, return, correction of an order, refund, a lawful adjustment to the relevant unsettled amount, or recovery through an appropriate legal process.
A disputed claim does not automatically make a rider, vendor, or buyer liable. awaKart will not impose arbitrary fines or make deductions without a reasonable basis and a lawful basis for doing so.
Where theft, fraud, threats, or another potentially unlawful act is reasonably suspected, awaKart may preserve relevant records and refer the matter to an appropriate authority where justified and permitted by law. Only competent authorities can determine criminal guilt.
10. Payments, Fees and Settlements
awaKart coordinates buyer payment collection and subsequent settlements to vendors and riders under its applicable transaction and settlement process. The checkout page should display the applicable order amount and charges before the buyer confirms payment.
Depending on the transaction, the amount payable may include:
- The price of the goods ordered.
- A delivery fee, where delivery is selected and a fee applies.
- A processing or service fee, where applicable and disclosed before payment.
- Other expressly disclosed charges applicable to the specific transaction.
Buyers should review the checkout total before completing payment. Vendors and riders should review the relevant settlement information and report discrepancies through the official support channel.
Collection and settlement
Payment collection by awaKart does not mean that a vendor or rider has already received their settlement. Vendor and rider settlements may be processed after the applicable transaction checks and fulfilment steps, in accordance with the platform's operational procedures and any applicable payment-provider requirements.
Settlement timing may be affected by payment confirmation, transaction reconciliation, incomplete fulfilment, a genuine dispute, a suspected fraudulent transaction, or a technical or payment-provider delay. Where reasonably practicable, affected parties should be informed of material delays and the steps needed to resolve them.
Where a specific order is subject to a genuine, documented dispute, awaKart may temporarily restrict the portion of an unsettled amount reasonably connected to that dispute only where justified and legally permitted. Any adjustment, deduction, or recovery must have an appropriate contractual and legal basis. Unrelated or undisputed amounts should not be withheld arbitrarily.
awaKart does not promise that every payment or settlement will be instantaneous. Processing times may depend on the payment provider, banking systems, verification requirements, and other factors outside the platform's reasonable control.
Users must not submit false payment confirmations, manipulate transaction references, or attempt to obtain goods or settlements through fraudulent means. A payment should be treated as confirmed only when the applicable payment process indicates successful confirmation.
11. Cancellations, Returns and Refunds
Cancellation, return, replacement, and refund eligibility depends on the circumstances of the order, the status of fulfilment, the applicable product conditions, and Nigerian law.
A buyer who wants to cancel an order should make the request as early as possible through the available platform process. A cancellation may not be possible after an order has been prepared, collected, or delivered, particularly where fulfilment costs have already been incurred. This does not remove any cancellation, return, or refund right that the law requires.
Where an order is not fulfilled, is materially different from its description, arrives damaged, is incomplete, or is otherwise eligible for a remedy, awaKart may review the complaint and coordinate an appropriate outcome.
Depending on the facts and applicable law, a resolution may involve replacement, correction, redelivery, return, a partial refund, or a full refund. The remedy will depend on the nature of the problem and the rights of the parties.
Where a refund is approved, it may take additional time to appear in the buyer's account depending on the payment provider or financial institution. Any applicable non-refundable fee will be treated in accordance with the information disclosed before payment and applicable law.
No provision in these Terms is intended to remove a consumer's statutory rights or to permit awaKart or a vendor to refuse a remedy that is legally required.
12. Prohibited Conduct
You must not use awaKart to engage in unlawful, deceptive, abusive, or harmful activity. Prohibited conduct includes:
- Fraud, impersonation, payment manipulation, false claims, or deliberate interference with order records.
- Listing or attempting to sell prohibited, counterfeit, stolen, unsafe, or otherwise unlawful goods.
- Harassment, threats, intimidation, discrimination, or violence directed at buyers, vendors, riders, or platform personnel.
- Misusing personal information, accessing another person's account without authorization, or attempting to bypass security controls.
- Falsifying pickup, delivery, payment, verification, review, or settlement information.
- Interfering with the operation or security of the platform, including unauthorized access, malicious code, or abusive automated activity.
- Using the platform to evade applicable law or to arrange transactions that are prohibited by law.
This list is not exhaustive. Users must also comply with applicable law and reasonable, published platform rules.
13. Investigations and Account Actions
awaKart may review complaints, payment discrepancies, delivery incidents, suspected fraud, account misuse, and potential breaches of these Terms. Investigations are intended to establish the relevant facts and support a fair, proportionate response.
Where reasonably necessary to protect users, goods, funds, or the platform, awaKart may temporarily restrict a relevant feature, pause a disputed order, suspend new rider assignments, or limit an account while an investigation is ongoing. Any restriction should be proportionate to the identified risk and permitted by law.
Where reasonably practicable and consistent with safety, privacy, and the integrity of an investigation, the affected party will be told the general nature of the concern and given a reasonable opportunity to provide an explanation or relevant evidence.
After reviewing the available information, awaKart may close the complaint without action, correct an administrative error, facilitate a resolution, issue a warning, restrict relevant platform privileges, suspend or terminate an account, or pursue an appropriate lawful remedy.
Actions will be based on the available evidence and the seriousness of the issue. A complaint alone does not establish wrongdoing. The platform may take precautionary steps before an investigation is complete where necessary to address a credible and immediate risk, but such steps should not be treated as a final finding of liability.
Users may raise concerns about an investigation or account action through the official support channel. awaKart may retain relevant records for legitimate operational, dispute-resolution, fraud prevention, or legal purposes, subject to its Privacy Policy and applicable law.
14. Liability and Responsibility
awaKart provides the technology and processes through which users discover goods, place orders, and coordinate payment and delivery. The platform does not independently manufacture or own every product offered by vendors, and it cannot guarantee every statement made by every user.
Vendors remain responsible for the goods they list and supply, including the accuracy of product information and their fulfilment obligations. Riders remain responsible for their own conduct and for performing assigned deliveries with reasonable care. Buyers remain responsible for their own conduct, accurate order details, and compliance with these Terms.
awaKart and its operator will take reasonable steps to administer the platform and handle reported problems. However, to the extent permitted by law, we do not guarantee that the platform will always be uninterrupted, error-free, or available on every device or network.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including applicable statutory consumer protections. Nothing in these Terms prevents a party from pursuing a lawful remedy for proven loss or wrongdoing.
To the extent permitted by law, awaKart is not responsible for losses caused solely by events outside its reasonable control, such as widespread network failures, third-party financial system outages, or emergencies. This does not automatically excuse an obligation that remains enforceable under applicable law.
Each party remains responsible for its own unlawful conduct, negligence, contractual breaches, and obligations imposed by law, subject to the facts and any applicable legal defences.
15. Intellectual Property
The awaKart name, branding, platform design, software, original text, and other platform materials are owned by or licensed to the relevant rights holders, including Algoritic Inc. where applicable.
Subject to these Terms, users may access and use the platform for its intended marketplace purposes. You must not copy, redistribute, reverse engineer, commercially exploit, or misrepresent platform materials except where authorized by the rights holder or permitted by law.
Vendors retain responsibility for ensuring that they have the rights and permissions needed to upload product images, descriptions, logos, and other materials. By submitting content to awaKart, you authorize the platform to use, host, display, and process that content as reasonably necessary to operate the marketplace, promote the relevant listing, and fulfil the transaction, subject to applicable law and any relevant agreement.
You must not upload content that infringes another person's rights or violates applicable law. We may remove or restrict disputed content where reasonably justified.
16. Privacy and Personal Information
awaKart may process information needed to create and administer accounts, display listings, process orders and payments, coordinate deliveries, investigate complaints, prevent fraud, and maintain platform security.
Depending on how you use the platform, information may include account and contact details, order records, delivery details, transaction references, communications with support, and information required for vendor or rider verification.
Personal information should be accessed and used only for legitimate purposes connected with the service, applicable legal obligations, or other lawful grounds. Information may be shared with relevant transaction participants, service providers, payment providers, or competent authorities where necessary and legally permitted.
Our handling of personal information is described in the awaKart Privacy Policy. Please read it alongside these Terms:
Read the Privacy PolicyPersonal information will be handled in accordance with applicable Nigerian data protection law, including the Nigeria Data Protection Act 2023 where applicable. The specific information collected, service providers used, retention periods, and available privacy rights are addressed in the Privacy Policy.
17. Complaints and Dispute Resolution
We encourage buyers, vendors, and riders to raise transaction concerns promptly so that relevant information can be reviewed while it is still available.
When submitting a complaint, include the order reference, a clear explanation of the issue, the outcome you are seeking, and any relevant evidence that you can lawfully provide. Do not submit another person's sensitive information unless it is reasonably necessary and you have a lawful basis to do so.
awaKart may contact the parties involved, review available records, request further information, and propose a proportionate resolution. The platform may not be able to resolve a matter immediately, particularly where facts are disputed, evidence is incomplete, or an external payment provider must be contacted.
Where a complaint cannot be resolved through platform support, the parties may pursue any applicable rights or remedies before the relevant Nigerian regulator, consumer-protection body, law-enforcement agency, alternative dispute resolution process, or competent court.
These Terms are intended to operate consistently with the laws of the Federal Republic of Nigeria. Any applicable legal proceedings remain subject to the jurisdiction and procedures prescribed by Nigerian law.
View the complaints process18. Changes to These Terms
We may update these Terms to reflect changes to awaKart, its features, its operating procedures, applicable law, or the risks associated with marketplace transactions.
The updated version will be published on the relevant platform page with a revised update date. Where a change materially affects users or an ongoing service, we will take reasonable steps to communicate it where practicable and legally required.
Changes will not retrospectively remove rights that have already accrued or override mandatory legal protections. Continued use after an update takes effect constitutes acceptance only to the extent permitted by applicable law. If you do not agree to a material change, you should stop using the affected service and contact us about any outstanding transaction.
